US Foods Class Action Settlement

PLEASE NOTE: THE FILING DEADLINE TO SUBMIT A CLAIM TO THIS SETTLEMENT HAS PASSED. MCAG IS NO LONGER ACCEPTING ENROLLMENTS IN OUR SERVICE FOR THIS SETTLEMENT.  MCAG WILL UPDATE CLIENTS ACCORDINGLY ONCE INFORMATION IS AVAILABLE ON DISTRIBUTIONS FROM THIS SETTLEMENT.

This class action Settlement, which has a fund of $297 million, is about whether US Foods improperly inflated the purported "cost" of goods it sold to some of its customers.

Class Members include customers who purchased products from US Foods between 1998 and 2005, under a cost-plus purchasing arrangement, and for which a Value-Added Service Provider ("VASP") invoice was used in calculating the sales price for the transaction. If you purchased products from US Foods pursuant to a cost-plus arrangement at any time during the period of 1998 through 2005, when the alleged VASP system was in place, you may be a Class Member.

At present, no further action is needed if you are an MCAG Settlement Recovery Service client. MCAG is prepared to pursue this action on behalf of our current clients; however, the deadline for claims submission is anticipated to be no earlier than December 19, 2014. There is time to research and prepare for this opportunity. As the Settlement progresses, MCAG representatives will keep their clients informed, and will provide ample notice should further action or additional information or documentation be needed.
