The Prograf Settlement [In re: Prograf Indirect Purchaser Antitrust Litigation], with funds of $13.25 million to compensate eligible Class Members, has been established as a result of allegations Astellas violated antitrust laws by filing a baseless petition with the U.S. Food and Drug Administration as a means of delaying entry of a generic version of Prograf, a drug used to prevent organ rejection by kidney, liver, heart and lung transplant patients.
Eligible Class Members include all persons (“Consumers”) or entities (“Third Party Payers”) in the United States and its territories who purchased and/or paid for some or all of the purchase price for branded Prograf capsules and/or any of its AB-rated generic equivalents in any form in the states of Arizona, California, Delaware, District of Columbia, Florida, Georgia, Idaho, Illinois, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Pennsylvania, Puerto Rico, Rhode Island, South Dakota, Tennessee, Vermont, West Virginia and Wisconsin, for consumption at any time during the period from April 15, 2008 until December 31, 2010 (the “Class Period”).
